1. About ScanCDL
ScanCDL.com ("ScanCDL," "Company," "we," "us," or "our") is an online review and information platform for the United States trucking industry. ScanCDL allows registered users to submit reviews and reports about CDL drivers, freight brokers, dispatchers, carriers, repair shops, and other trucking industry professionals. ScanCDL is headquartered in the United States and its services are directed to users in the United States.
2. Eligibility
- You must be at least 18 years of age to register or use ScanCDL.
- You must be a legitimate US-based trucking industry professional, carrier, owner-operator, broker, or other industry participant.
- You must provide accurate and complete registration information.
- You may not create an account on behalf of another person without authorization.
- Individuals who have been previously banned from ScanCDL may not re-register.
3. User Accounts
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activity that occurs under your account.
- Notify us immediately at [email protected] if you suspect unauthorized access to your account.
- One account per person/company. Creating multiple accounts to circumvent restrictions is prohibited.
- Account credentials may not be transferred or sold.
4. Reviews & User Content
A. Accuracy & Truthfulness
By submitting a review or report, you certify under penalty of perjury that:
- The review is based on your genuine, first-hand experience with the reviewed party.
- All factual statements in the review are true and accurate to the best of your knowledge.
- You have personal, direct knowledge of the incidents described.
- You are who you claim to be and are affiliated with the company you registered under.
B. License to Display
By submitting content, you grant ScanCDL a non-exclusive, worldwide, royalty-free, perpetual license to display, reproduce, and distribute your review on the platform. You retain ownership of your content.
C. Content Moderation
All reviews are subject to moderation. We reserve the right to approve, reject, edit, or remove any review that violates these Terms, at our sole discretion, without notice.
D. Editing & Updating
You may edit your reviews within 30 days of submission via your Dashboard. After 30 days, contact us to request corrections to factual errors.
E. CDL Driver Reports
Reports about individual CDL drivers carry additional responsibilities because they concern a named person. When you submit a CDL Driver report you further certify that:
- The report is based on your own direct, first-hand working relationship with the driver (e.g. as their carrier, dispatcher, or broker).
- You hold documentary evidence (records, photos, logs, correspondence) supporting any negative factual claim, and will provide it if we request it.
- You understand the directory is a community reputation tool, not an employment-screening service, and you will not treat it as a background check.
- You will not post controlled-substance, alcohol, failed-test, refusal, or SAP/return-to-duty allegations here. That information belongs solely in the FMCSA Drug & Alcohol Clearinghouse.
A driver who is the subject of a report may dispute or request removal of it at any time via our Review Removal Request process, even if the driver is not a registered user. Knowingly false reports about an identifiable person may expose the submitter to defamation liability and will result in removal and account termination.
5. Prohibited Conduct
The following are strictly prohibited on ScanCDL:
- False Reviews: Submitting fabricated, invented, or knowingly false reviews about any person or company.
- Defamation: Making false statements of fact that damage someone's reputation.
- Competitor Attacks: Submitting negative reviews for competitive business purposes rather than genuine experience.
- Review Manipulation: Paying, incentivizing, or coercing others to submit positive reviews about yourself or negative reviews about competitors.
- Harassment: Using the platform to harass, intimidate, or stalk any individual.
- Privacy Violations: Disclosing another person's private information (home address, personal phone number, Social Security Number, etc.) without consent.
- Hate Speech: Content that discriminates or promotes hatred based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin.
- Impersonation: Impersonating any person, company, or entity.
- Scraping & Automated Access: Using bots, scrapers, or automated tools to access, collect, or index ScanCDL data without our written permission.
- FCRA Misuse: Using ScanCDL data as a consumer report or for employment screening purposes in violation of the Fair Credit Reporting Act.
- Drug & Alcohol Allegations: Posting controlled-substance, alcohol, failed-test, refusal, or SAP/return-to-duty claims about a driver. This regulated information must be reported only through the FMCSA Drug & Alcohol Clearinghouse, not on ScanCDL.
- Interference: Attempting to hack, overload, or disrupt the platform's infrastructure or security.
- Illegal Activity: Any use of the platform that violates applicable federal, state, or local law.
Violations may result in immediate account termination, content removal, and/or referral to law enforcement. ScanCDL reserves the right to pursue legal remedies for violations that cause damage to the platform or its users.
6. FCRA Disclaimer — Not a Consumer Reporting Agency
You may NOT use information from ScanCDL as the basis for, or as a factor in:
- Making employment decisions (hiring, firing, promotion, demotion, reassignment)
- Denying credit, insurance, housing, or any other benefit covered by FCRA
- Any other purpose regulated by the Fair Credit Reporting Act, 15 U.S.C. § 1681 et seq.
ScanCDL reviews are unverified user opinions. For employment screening, always use FCRA-compliant services such as DAC/HireRight, PSP (FMCSA Pre-Employment Screening Program), or licensed background check providers. Misuse of ScanCDL data for FCRA-regulated purposes is solely your responsibility and liability.
This disclaimer applies in full to the CDL Driver Directory. Driver entries and reports are unverified community opinions for reputation purposes only and may not be used to make hiring, retention, or other FCRA-regulated decisions. For lawful pre-employment screening, use PSP, MVRs, and the FMCSA Drug & Alcohol Clearinghouse.
7. No Verification of Reviews
ScanCDL does NOT independently verify the accuracy, truthfulness, or authenticity of user-submitted reviews. Reviews represent the personal opinions and experiences of individual users. ScanCDL makes no representations or warranties regarding the accuracy of any review.
If you are the subject of a review and believe it is false, inaccurate, or violates these Terms, you may submit a Review Removal Request. We will investigate and take appropriate action within a reasonable timeframe.
8. Search Credits & Payments
- Search credits, once purchased, are non-refundable except as required by applicable law or at our sole discretion.
- Credits do not expire unless otherwise stated at time of purchase.
- Credits are tied to your account and cannot be transferred to other accounts.
- We reserve the right to modify credit pricing at any time. Changes do not affect already-purchased credits.
- If paid search is disabled (returned to free), existing credits remain in your account for future use.
- In the event of account termination due to Terms violations, credits are forfeited without refund.
9. Referral Program
- Referral codes may only be shared honestly. You may not misrepresent ScanCDL to obtain referrals.
- Self-referrals (referring yourself via a secondary account) are prohibited.
- We reserve the right to cancel referral rewards if fraud or abuse is detected.
- Referral program terms may change at any time with notice.
10. Partner Program
- Partner status is granted at ScanCDL's sole discretion and may be revoked at any time for violations of these Terms.
- API partners may only use data as expressly permitted in their partner agreement.
- Partners may not resell, sublicense, or redistribute ScanCDL data without written permission.
- White label licensees must adhere to the same content standards as ScanCDL.
11. Intellectual Property
The ScanCDL name, logo, platform design, code, and proprietary algorithms are owned by ScanCDL and protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our written consent.
User-submitted reviews remain the property of the submitter, subject to the license granted in Section 4(B). You represent that you own or have rights to any content you submit.
12. DMCA & Copyright
If you believe content on ScanCDL infringes your copyright, please send a DMCA notice to: [email protected]. Your notice must include: (1) identification of the copyrighted work; (2) identification of the infringing material and its location; (3) your contact information; (4) a statement of good faith belief; (5) a statement of accuracy under penalty of perjury; (6) your signature.
13. Disclaimer of Warranties
SCANCDL IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES. YOUR USE OF THE PLATFORM IS AT YOUR SOLE RISK.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SCANCDL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE PLATFORM, OR ANY CONTENT OBTAINED FROM THE PLATFORM, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY.
In jurisdictions that do not allow the exclusion of certain warranties or limitation of liability, our liability is limited to the greatest extent permitted by applicable law. In no event shall our total liability exceed the amount paid by you to ScanCDL in the 12 months preceding the claim.
15. Indemnification
You agree to defend, indemnify, and hold harmless ScanCDL, its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your violation of these Terms; (b) your User Content; (c) your use of the platform; or (d) your violation of any third-party rights, including any intellectual property, privacy, or publicity rights.
16. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the United States and the state of Illinois, without regard to its conflict of law provisions.
Informal Resolution: Before filing a formal dispute, you agree to contact us at [email protected] and attempt to resolve the dispute informally for at least 30 days.
Class Action Waiver: To the extent permitted by law, you agree to resolve disputes individually and waive any right to bring or participate in a class action lawsuit against ScanCDL.
17. Termination
ScanCDL may suspend or terminate your account at any time, with or without cause or notice, for violations of these Terms, suspicious activity, or any reason we deem appropriate in our sole discretion.
You may terminate your account at any time by contacting us at [email protected]. Upon termination, your right to use the platform ceases immediately. Provisions that by their nature should survive termination (including Sections 6, 13, 14, 15, 16) will survive.
18. Changes to Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify registered users by email or prominent platform notice. Your continued use of ScanCDL after changes are posted constitutes your acceptance of the revised Terms. If you disagree with changes, you must stop using the platform and may request account deletion.
